Homeowner, Association in Court Battle

Written by on August 7, 2018

A civil dispute among neighbors has become so heated that the courts have become involved.
The homeowners association in a subdivision east of Cody has filed suit against the owners of a home who have painted their house in alternating colors of gray, maroon, walnut and cinnamon. According to court documents, Kelly and Debra Hennessy are in violation of the Cody Ranchettes Homeowners Association rules that dictate the walls of the house need to be one color, with one color for the trim, and that their painting plans must be approved by the association’s Architectural Control Committee.
The Powell Tribune reports that the Hennessys are strenuously objecting to the Homeowner’s Association’s actions, saying that the association is overstepping its authority. In documents submitted to the court, Kelly Hennessy used profanity and an angry and aggressive tone in letters responding to the association’s attempts to settle the matter without going to court.
According to the article, no trial date has yet been set.
